All EGR delete kits, emissions-related components, tuning products, and associated hardware sold by Big Dawg Diesel, (“Seller”) are sold strictly for off-road, race, or competition use only. These products are not legal for use on public roads or highways and are not certified to comply with the Clean Air Act, Environmental Protection Agency regulations, or any state or local emissions laws. The customer acknowledges and agrees that they are solely responsible for determining whether the purchase, installation, or use of any product complies with applicable laws and regulations.
By purchasing, installing, or using any such product, the customer knowingly and voluntarily assumes all risks associated with its use, including but not limited to emissions violations, fines, penalties, citations, inspection failures, registration denial, voided manufacturer warranties, reduced engine life, drivetrain damage, or diminished vehicle value. Big Dawg Diesel does not advise, encourage, or represent that any emissions-related product is legal for street or highway use, and no statements made by employees, agents, or resellers shall be interpreted otherwise.
All products are sold “AS IS” and “WITH ALL FAULTS,” without any warranties of any kind. Big Dawg Diesel expressly disclaims all express, implied, or statutory warranties, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, or compliance with emissions or environmental laws. No employee, agent, or representative of Big Dawg Diesel has the authority to modify or extend any warranty or representation beyond what is expressly stated herein.
To the maximum extent permitted by Texas law, Big Dawg Diesel shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the purchase, installation, use, or inability to use any product. This limitation includes, but is not limited to, loss of use, loss of revenue, loss of vehicle value, government fines or penalties, regulatory enforcement actions, or third-party claims. In no event shall Big Dawg Diesel’s total liability exceed the purchase price paid for the product.
The customer agrees to fully defend, indemnify, and hold harmless Big Dawg Diesel, its owners, officers, employees, affiliates, and agents from and against any and all claims, demands, damages, losses, penalties, fines, costs, and expenses, including reasonable attorney fees, arising out of or related to the purchase, installation, possession, or use of any emissions-related product, including but not limited to claims brought by governmental or regulatory agencies.
Due to the nature of emissions-related products, all sales are final and non-refundable. No returns, refunds, or exchanges will be accepted for any EGR delete kit or related emissions product, whether opened, installed, or unused. Big Dawg Diesel does not control or supervise installation, vehicle condition, tuning, or vehicle operation, and any installation or use of a product is performed at the customer’s sole risk and responsibility.
This policy shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to this policy or the sale of any product shall be brought exclusively in a court of competent jurisdiction located within the State of Texas. If any provision of this policy is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Purchase, installation, or use of any product constitutes the customer’s full and binding acceptance of this policy and all terms contained herein.
